Terms & Conditions
- A Hire agreement between Iron Hearse Limited and a Hirer will be only be completed once the following has been completed in this order:
i) Iron Hearse Limited Booking Request Form submitted with all required information and any additional requirements.
ii) The prospective Hirer or their representative is supplied a dated quote (plus any options) with a copy of a Booking Agreement Form to which it relates. All quotes will include a period for which the quote is valid.
iii) Full payment is received in cleared funds by Iron Hearse Limited with the Booking Agreement (Signed) which includes any options taken. Only employees or directors of Iron Hearse may operate any vehicle registered to the company. - The booking is only for the duration and on the date set out on the Booking Agreement.
- The start location, stopping / resting points, and final destination must all be on the Booking Agreement.
- Any overrun will be chargeable at the rate of £25 per 30 minutes or part thereof.
- The vehicle is only hired for the purposes as set out in the booking form.
- Any variation to the booking must be agreed at least 24 hours before the booking date by Iron Hearse Ltd and any additional fees paid for any variation in booking to be made.
- If the vehicle is not available on the day of hire due to damage or breakdown then the full sum paid will be refundable to the hirer for the provision of an alternative vehicle either to the hirer or the funeral director as appropriate. The non-availability will be communicated to the funeral director at the earliest opportunity.
- It is the responsibility of the hirer to ensure a coffin / casket fits the hearse chosen.
- The motorcycle hearse will be insured by Iron Hearse Ltd for the full duration of the hire set out in the booking form.
- All routes, access, timings and compliance with road regulations are the responsibility of the hirer and no infringement of the highway code will be made to facilitate any aspect of the booking made.
- Any signage, tributes, adornments or other items may be refused if they may in the view of the Iron Hearse Carriage Master damage the motorcycle hearse in anyway.
- Iron Hearse reserves the right to refuse any booking.
- Every reasonable effort will be made to comply with a hire as set out in a booking form, but deviation from a hire may occur due to errors in routing, weather conditions, road conditions (including traffic) and other factors outside of the control of Iron Hearse Ltd or the carriage master and as such should be considered by the hirer and reasonable allowance made.
- Termination of an agreement will only be considered as being made if made in writing (physical letter or Email) at the time of receipt by Iron Hearse Ltd.
- If the hirer terminates an agreed booking then payment will be retained at the following rate:
Within 48 hours of booking commencement = 100%
Within 5 days (120 hours) of booking commencement = 75%
Within 10 days (240 hours) of booking commencement = 50%
With more than 10 days notice, but after hire agreement made = 20% - Iron Hearse Ltd reserves the right to terminate any hire If a hirer is in breach of the companies Terms & Conditions or is (or may) bring Iron Hearse limited into disrepute. Payment will be retained at the rates applicable for hirer termination as set out above.
- Any additional debts incurred by or in relation to a booking agreement or in the process of a hire must be settled in 7 days or incur a 5% late payment fee, after 28 days debt collection may
be started at the hirers expense for the amount and any costs accrued. - Commercial use of photographs or any other images of the Motorcycle Hearse (or part thereof) or the carriage master is not permissible without the prior and explicit permission of Iron Hearse Limited at any time or in anyway.
- Iron Hearse Limited may use images for promotional purposes providing the image centres on the Motorcycle Hearse / Hearse procession or Carriage Master / Undertaker / Pallbearers.
Written testimony will only be used with the consent of those providing it. - Iron hearse Limited will treat all data provided to them with respect and sensitivity. Data will be securely stored and may be processed in confidence to enable the business to function and services to be provided. Data will be stored and processed by Iron Hearse Limited in line with UK data legislation including GDPR. It may be necessary for data to be passed to third parties to provide services although Iron Hearse Limited will keep any data sharing to a minimum.
- If any Term or Condition is or becomes irrelevant or not enforceable it will not invalidate any other Term or Condition in this agreement.
- No Term or Condition in this document limits or restricts Iron Hearse Limited’s Liability for Death or Personal Injury under English Law.
- By signing the Booking Agreement you are agreeing to Iron Hearse Limited’s Terms and Conditions.
